By accessing or using CabinetCalc, you agree to these Terms of Service. If you do not agree, do not use the Service.
1. Service and Eligibility
"CabinetCalc," the "Service," includes the CabinetCalc.app website, application, calculation tools, optimization features, exported outputs, documentation, and related services. You may use the Service only if you can form a binding legal agreement and will use the Service in compliance with applicable law.
If you use the Service on behalf of a company, shop, or other entity, you represent that you have authority to bind that entity to these Terms.
2. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and current information and promptly update it if it changes.
- You may not share accounts in a way that exceeds your purchased plan or intended use.
- You must notify CabinetCalc promptly of any suspected unauthorized use or security incident.
- CabinetCalc is not liable for loss caused by your failure to safeguard credentials.
3. Subscriptions and Billing
CabinetCalc may offer free, beta, trial, monthly, annual, and other paid subscription plans. Plan details, features, usage limits, and pricing may be posted within the Service or on the website.
Automatic Renewal
Unless otherwise stated, paid subscriptions automatically renew at the end of each billing cycle until canceled.
Authorization
By subscribing, you authorize CabinetCalc and its payment processor to charge the applicable recurring fees, taxes, and any other disclosed charges to your selected payment method.
Cancellations
You may cancel renewal before your next billing date. Cancellation stops future renewal charges but does not retroactively refund amounts already paid unless required by law.
Refunds
Except where required by law, subscription fees are non-refundable, including for partial billing periods, unused time, feature changes, or account inactivity.
Price Changes
CabinetCalc may change pricing, plan structure, or included features on reasonable notice. Continued use after the effective date of a pricing change constitutes acceptance of the updated pricing.
Taxes
You are responsible for any applicable sales, use, value-added, withholding, or similar taxes, excluding taxes based on CabinetCalc's net income.
4. Limited License
Subject to these Terms, CabinetCalc grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business or personal workflow purposes.
This license does not transfer any ownership rights. No rights are granted except those expressly stated in these Terms.
5. Intellectual Property
The Service, including all software, source and object code, algorithms, formulas, calculation engines, optimization routines, workflows, user interface designs, look and feel, databases, text, graphics, branding, names, logos, documentation, and underlying technology, is and remains the exclusive property of Bradley Beach, creator and founder of CabinetCalc, Kansas City, Missouri, and/or CabinetCalc's licensors.
These materials are protected by copyright, trademark, trade secret, and other intellectual property laws. CabinetCalc retains all right, title, and interest in and to the Service.
6. Prohibited Conduct
You may not, and may not allow any third party to:
- copy, reproduce, republish, distribute, sell, lease, sublicense, or commercially exploit the Service except as expressly allowed;
- reverse engineer, decompile, disassemble, decode, attempt to derive source code, or otherwise extract the underlying logic of the Service;
- use outputs, observations, benchmarking, prompts, system interactions, or repeated testing to derive, replicate, or approximate CabinetCalc's proprietary formulas, calculations, or optimization methods;
- build, train, improve, validate, or support a competing product or service using the Service or insights derived from it;
- use bots, scripts, crawlers, scrapers, or automated requests to access, query, harvest, or extract data, outputs, or system behavior;
- interfere with or disrupt the integrity, performance, or security of the Service, including by scanning, probing, load testing, or attempting unauthorized access;
- circumvent plan limits, access controls, or technical restrictions;
- use the Service for unlawful, infringing, fraudulent, misleading, or harmful purposes; or
- remove or obscure proprietary notices or attributions.
7. Outputs, Verification, and User Responsibility
CabinetCalc generates dimensions, cut lists, material estimates, layouts, and related outputs based on information supplied by the user. All outputs are provided for informational, planning, estimation, and workflow purposes only.
- You are solely responsible for verifying all dimensions, calculations, quantities, tolerances, material assumptions, hardware selections, fabrication methods, and purchase decisions before use.
- You are solely responsible for safety, code compliance, engineering, structural review, jobsite decisions, and finished construction results.
- CabinetCalc does not provide engineering, architectural, structural, code, legal, tax, accounting, or professional construction advice.
You retain ownership of the data and project information you submit, but CabinetCalc retains ownership of the Service and all methods used to generate outputs.
8. Beta Terms
Certain features may be labeled or provided as beta, preview, early access, or test features. Beta features may be incomplete, inaccurate, unstable, or changed or withdrawn at any time without notice.
- Data created during beta may be lost, deleted, or become inaccessible.
- Features, calculations, and interfaces may change without notice.
- Beta access may be limited, suspended, or terminated at any time.
If you provide suggestions, bug reports, or other feedback, you grant CabinetCalc a perpetual, irrevocable, worldwide, royalty-free right to use that feedback for any purpose without compensation or attribution.
9. Data, Availability, and Third-Party Services
CabinetCalc may use third-party providers for hosting, authentication, analytics, communications, billing, file storage, and related operations. Your use of certain parts of the Service may therefore also involve third-party services.
CabinetCalc does not guarantee uninterrupted availability, permanent storage, or retention of any project data, exports, or account content. You are responsible for maintaining your own backups and exported records.
10. Disclaimer of Warranties and Limitation of Liability
Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, security, or uninterrupted availability.
Limitation of Liability
To the fullest extent permitted by law, CabinetCalc and Bradley Beach shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, materials, fabrication outcomes, or procurement costs, arising out of or related to the Service.
To the fullest extent permitted by law, the total aggregate liability of CabinetCalc and Bradley Beach for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid to CabinetCalc for the Service in the three months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
11. Indemnification
You agree to defend, indemnify, and hold harmless CabinetCalc and Bradley Beach from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your submitted content or data, your violation of these Terms, or your violation of any law or rights of a third party.
12. Suspension and Termination
CabinetCalc may suspend, restrict, or terminate your access to the Service, in whole or in part, at any time and without liability, including for security concerns, suspected abuse, nonpayment, excessive usage, legal compliance, or violation of these Terms.
Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive will survive, including provisions relating to intellectual property, restrictions, warranties, limitations of liability, indemnification, payment obligations, and dispute resolution.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration in Missouri, except that CabinetCalc may seek injunctive or equitable relief in any court of competent jurisdiction to protect confidential information, intellectual property, or trade secrets.
You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative action, to the extent permitted by law.
14. Changes to Terms; Contact Information
CabinetCalc may update these Terms from time to time. Updated Terms become effective when posted unless another date is stated. Continued use of the Service after updated Terms are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and CabinetCalc regarding the Service and supersede prior or contemporaneous understandings regarding the Service.
